FOR PUBLICATION July 1, 1997 This is an appeal from a sentence of death, which was imposed after a second sentencing hearing. 2 The principal issues are (1) whether the evidence of unrelated and unadjudicated criminal conduct presented by the prosecutor in the case-in-chief in the penalty phase, although admissible under State v. Jackson, 608 So.2d 949 (La. 1992), injected an arbitrary factor into the proceeding in violation of defendant's due process rights, and (2) whether the execution of an offender who is both young and mentally retarded violates the prohibition against excessive punishment in the Louisiana Constitution. 3
